As a general rule, a Mediator/Arbitrator cannot communicate with any party to the dispute except in the presence of the other party. This presents a challenge, as ex-parte communication may be necessary, for example, when receiving documents from one party or making logistical arrangements, such as the time and venue for a meeting.

The firm has engaged Rachel to bridge this gap by serving as the administrative secretary to our Mediation Panel and Arbitral Tribunal. In so doing, the practitioners remain alive to the rules and practice of ADR and vigorously guides its mandate by ensuring that it does not improperly delegate any roles beyond that which is permitted or receive her views on the substance of any case.
